US Judge Orders Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the court noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court proceedings involve conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
Terms of Release
The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a significant turn in a complicated legal battle involving allegations of wrongful detention and disputed gang affiliations.
